Varied Construction Contract Categories

Lump Sum Contract (Fixed Price Contract)

  • A single fixed price for the entire project.
  • Suitable when scope, drawings, and specifications are clearly defined
  • Risk is mostly on the contractor.

Item Rate Contract (Unit Price Contract)

  • Payment is based on quantities executed × pre-agreed rates.
  • Common in PWD, CPWD, and government works.
  • Scope may vary depending on actual site conditions.

EPC Contract (Engineering, Procurement & Construction)

  • Mostly used in large infrastructure and industrial projects.
  • Contractor takes full responsibility: engineering, materials procurement & construction.
  • Common in power plants, oil & gas, solar farms.

Cost Plus Contract

  • Client pays: Actual construction cost (materials, labour, machinery) + A fixed fee or percentage for contractor’s profit.

  • Cost + Incentive Fee (bonus for early completion)
  • Cost + Guaranteed Maximum Price (GMP)

Labour Contract

  • Contractor supplies only labour.
  • Materials are provided by the client.
  • Suitable for small to medium private projects.

Material Contract

  • Contractor supplies only materials.
  • Client manages labour separately.

Labour + Material Contract (Fully Itemised)

  • Contractor supplies both labour and materials.
  • Often used by private builders.

BOOT / BOT Contracts

  • Used mostly in infrastructure:
  • Build–Operate–Transfer (BOT)
  • Build–Own–Operate–Transfer (BOOT)
  • Contractor builds and operates the facility for a period before transferring to Third Party/ Government.

Subcontract Agreements

  • Structural subcontract
  • MEP subcontract
  • Finishing subcontract
  • Aluminium & glazing subcontract
  • Subcontractors work under a main contractor.

Joint Venture & Consortium Contracts

  • Two or more companies share responsibilities.
  • Useful for mega projects requiring combined expertise.

Time & Material Contract

  • Payment based on actual time spent + materials used.
  • Suitable when work scope is unclear.

Construction Management Contract

  • Client hires a Construction Manager to oversee project.
  • CM may act as adviser or as-at-risk contractor.
